The 2018 Farm Bill legalized industrial production of hemp and its marketing as well as the marketing of its derivatives in interstate commerce. That, however, is only the first step. Currently, USDA and the FDA are preparing to enter rulemaking procedures to regulate the use of hemp and hemp-based products. The same day that the president signed the farm bill, the FDA issued a statement warning the marketplace about getting out ahead of these regulations in both pharmaceutical and food use. It currently allows the incorporation of hulled hemp seeds, hemp seed protein and hemp seed oil into food and beverages, provided there are no label claims on curative powers and disease treatment.
