WOTUS is Back In February, the Trump administration promulgated a “suspension rule” that effectively delayed the implementation of the Waters of the United States (WOTUS) rule for two years. Yesterday the U.S. District Court for the District of South Carolina decided that the administration did not properly follow the Administrative Procedures Act in opening up the suspension rule to comments. The original rule had a 200-day comment period. The U.S. Supreme Court determined that the many challenges to the rule belonged at the federal district court level. WPI’s team was retained by the governing board of a U.S. industry organization to review a decision, reached by vote, to invest significant assets into the development and management of an export trading company. WPI’s team conducted a formal review of this decision and concluded that the current level of market saturation would limit the benefits of the investment. Based on WPI’s analysis and recommended actions, the board subsequently reversed its decision and undertook a strategic planning effort to identify more impactful investments.
