The Supreme Court of the United States (SCOTUS) ruled on the Sackett v EPA case yesterday regarding the definition of waters of the United States (WOTUS) under the Clean Water Act (CWA). Topline takeaways are as follows: this does not per se change the EPA’s latest WOTUS rule which took effect in March 2023, but it does undermine a key principle on what that regulation was based.
