The battle over the definition of "waters of the U.S." has been ongoing for decades, driving the wetlands issue. Most recently, the Environmental Protection Agency (EPA) and the U.S. Army Corps of Engineers (USACE) in April released a draft guidance to clarify protection of waters under the Clean Water Act (CWA). The agencies received about 230,000 public comments on the draft guidance.The EPA and USACE have submitted a final guidance to the Office of Management and Budget (OMB) for federal interagency review. The guidance is focused on protection of smaller waters that feed into larger ones to keep downstream water safe from upstream pollutants.
