USDA’s Agricultural Marketing Service (AMS) released the second of a series of three new Packers and Stockyards Administration marketing rules. Officially, it is the Inclusive Competition and Market Integrity Under the Packers and Stockyards Act but is informally referred to as the “scope” rule – setting out the scope of jurisdiction of the Packers and Stockyards Act, specifically with regard to “prohibiting undue prejudice, unjust discrimination, and deception to provide for clearer, more effective standards ….” This series of three rules is highly similar to those put forth by the Obama Administration in 2010 and 2016, per the 2008 farm bill which called for new regulations. WPI’s team was retained by the governing board of a U.S. industry organization to review a decision, reached by vote, to invest significant assets into the development and management of an export trading company. WPI’s team conducted a formal review of this decision and concluded that the current level of market saturation would limit the benefits of the investment. Based on WPI’s analysis and recommended actions, the board subsequently reversed its decision and undertook a strategic planning effort to identify more impactful investments.
