USDA Issues New Livestock and Poultry Contracting Rule

USDA’s Agricultural Marketing Service (AMS) released the second of a series of three new Packers and Stockyards Administration marketing rules. Officially, it is the Inclusive Competition and Market Integrity Under the Packers and Stockyards Act but is informally referred to as the “scope” rule – setting out the scope of jurisdiction of the Packers and Stockyards Act, specifically with regard to “prohibiting undue prejudice, unjust discrimination, and deception to provide for clearer, more effective standards ….” This series of three rules is highly similar to those put forth by the Obama Administration in 2010 and 2016, per the 2008 farm bill which called for new regulations. On behalf of a Canadian oilseed processer WPI's team provided market analysis, econometric modeling and financial due diligence in support of a $24 million-dollar investment in a Ukrainian crush plant. Consistent with WPI's findings, local production to supply the plant and the facility's output have expanded exponentially since the investment.
