EPA Administrator Andrew Wheeler and Assistant Secretary of the Army for Civil Works (Army Corps of Engineers) R.D. James, yesterday announced EPA’s revised wetland rule under the Clean Water Act of 1977 (CWA) which will replace the Waters of the United States (WOTUS) rule promulgated in 2015. Since the 2015 WOTUS rule was issued it has been temporarily blocked by the courts in 28 states and thus is in effect in 22 states. The new rule will cover all 50 states.
