The Supreme Court of the United States (SCOTUS) ruled on the Sackett v EPA case yesterday regarding the definition of waters of the United States (WOTUS) under the Clean Water Act (CWA). Topline takeaways are as follows: this does not per se change the EPA’s latest WOTUS rule which took effect in March 2023, but it does undermine a key principle on what that regulation was based. So as WPI noted on 3 January 2023 shortly after EPA published the final WOTUS rule the month before: “The case could upend the new WOTUS rule, ….”   Another key point in that regard, the Court’s decision was unanimous.
